By accessing or using the WellCon website (wellcon.com and related subdomains, the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Site.
These Terms apply to all visitors, consumers searching for wellness professionals, and anyone who browses or interacts with the Site without a member account. If you are applying for or maintaining a member professional listing, the WellCon Member Terms & Conditions apply in addition to these Terms.
2. About WellCon
WellCon is a vetted directory and professional network connecting health and wellness seekers with credentialed wellness professionals. WellCon reviews applications and verifies credentials as part of its listing process; however, WellCon is a directory platform and is not a healthcare provider, wellness service provider, or referral service. WellCon does not provide medical advice, diagnoses, treatment recommendations, or professional wellness services of any kind.
3. Use of the Site
3.1 Permitted Use
You may use the Site to:
Search for and browse listed wellness professionals
View professional profiles and credentials
Contact listed professionals through available contact methods
Subscribe to WellCon communications
Access WellCon content and resources
3.2 Prohibited Conduct
You may not:
Use the Site for any unlawful purpose
Scrape, crawl, or systematically extract data from the Site without written permission
Use the Site to send unsolicited communications (spam) to listed professionals
Impersonate any person or entity
Attempt to gain unauthorized access to any part of the Site or its systems
Use automated tools to interact with the Site in ways that interfere with its operation
Copy, reproduce, or redistribute WellCon content without authorization
Use WellCon's name, logo, or branding without express written consent
4. Directory Listings - Important Disclaimers
4.1 Nature of the Directory
WellCon maintains a directory of wellness professionals who have passed our application and credential verification process. Listing on WellCon means a professional has satisfied WellCon's membership requirements at the time of their application review. It does not mean:
WellCon endorses, recommends, or guarantees the services of any listed professional
WellCon has verified the accuracy of all information a professional provides about their practice
A listed professional is appropriate for your specific health or wellness needs
A listed professional holds any particular license required in your jurisdiction
4.2 No Medical Advice
Nothing on this Site constitutes medical advice, diagnosis, or treatment. Wellness information and professional profiles are provided for informational purposes only. Always consult a qualified healthcare provider before beginning any wellness program or making health-related decisions.
4.3 Your Responsibility
You are solely responsible for evaluating whether a listed professional is appropriate for your needs, verifying current licensure or certification status through applicable governing bodies, and making independent decisions about engaging any professional's services. WellCon is not a party to any agreement between you and a listed professional.
4.4 Credential Currency
WellCon verifies credentials at the time of application. Credentials, licenses, and certifications can lapse, be suspended, or be revoked after a member is listed. WellCon does not conduct real-time verification and cannot guarantee that a professional's credentials remain current after their listing is approved.
5. Intellectual Property
All content on the Site, including text, graphics, logos, design elements, and the WellCon name and brand, is owned by or licensed to Katharine Sawyer LLC, doing business as WellCon and is protected by applicable intellectual property laws.
You may view and print content from the Site for your personal, non-commercial use only. You may not reproduce, distribute, modify, or create derivative works from Site content without our express written permission.
6. Third-Party Links and Resources
The Site may contain links to third-party websites, resources, or professionals' own websites. These links are provided for convenience only. WellCon has no control over, and assumes no responsibility for, the content, practices, or policies of any third-party sites. Linking does not constitute an endorsement.
7. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
WellCon does not warrant that:
The Site will be uninterrupted, error-free, or secure
Any professional's credentials, information, or qualifications are accurate or current
The Site is free of viruses or harmful components
Results obtained from use of the Site will be accurate or reliable
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WELLCON AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING BUT NOT LIMITED TO:
Reliance on any professional listing or information displayed on the Site
Your engagement with or use of services provided by any listed professional
Any harm, injury, or loss resulting from services obtained through the Site
Errors or omissions in directory listings
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SITE SHALL NOT EXCEED $100.
Some jurisdictions do not allow certain liability exclusions; in those cases, our liability is limited to the maximum extent permitted by law.
9. Indemnification
You agree to indemnify, defend, and hold harmless WellCon and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third party's rights.
10. Privacy
Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms. Please review it at wellcontoday.com/privacy.
11. Changes to the Site and Terms
We reserve the right to modify, suspend, or discontinue the Site (or any part of it) at any time without notice. We may also update these Terms at any time. Updated Terms will be posted on the Site with a revised effective date. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Travis County, Texas, and you consent to personal jurisdiction in those courts.
